Legal basis

The EU General Data Protection Regulation, the Data Protection Act 2000 and the Data Protection Amendment Act 2018 serve the right to protection of personal data. We process your data exclusively on the basis of the legal provisions (DSGVO, DSG 2018, TKG 2003).

It is of particular concern to us to protect and securely store all personal data that you entrust to us. In this document you will learn more about how we use and process your personal data.

Purpose, legal basis, storage period and data recipients

We need the collected personal data for e.g.: contract fulfillment, billing, assertion of contractual claims, for customer service purposes and for advertising purposes. The data is collected, stored, processed and used for this purpose.

The legal basis for the processing of your personal data are on the one hand contract performance (eg online shopping), legitimate interests, the fulfillment of our legal or contractual obligations and on the other hand your consent (eg contact form, newsletter, cookies). Failure to provide the data may have different consequences.

In addition, external service providers process personal data on our behalf. We have carefully checked these and contractually obligated them to protect the transmitted data. Such service providers are, for example, the postal service, tax consultants, IT service providers. The data of our employees are processed externally by the payroll department.

We process your personal data, insofar as necessary, for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) and beyond that in accordance with the statutory retention and documentation obligations, which arise, among other things, from the Unternehmensgesetzbuch (UGB), the Bundesabgabenordnung (BAO), as well as until the end of any litigation, ongoing warranty and guarantee periods, etc.

In the course of operating our websites, we commission processors who may gain access to your personal data in the course of their activities, insofar as they require the data to perform their respective services. They have undertaken to comply with the applicable data protection regulations. Order processing contracts have been concluded in accordance with Art 28 DSGVO.


Contact form

Your information including personal data from our contact form will be transmitted to us via our own mail server to process your request, processed and stored by us. This data will not be collected or passed on without your declaration of consent. Without this data, we cannot process your requests. The data processing is based on the legal provisions of § 96 para 3 TKG and Art 6 para 1 lit a (consent) DSGVO.

We store the data for the duration of the inquiry response and for any queries. In addition, we keep your inquiries for up to a further six months so that you can refer to an older inquiry at a later date.

Online purchase

We would like to point out that for the purpose of simplifying the shopping process and for subsequent contract processing, the IP data of the connection owner are stored by the webshop operator mariedares e.U. within the framework of cookies, as are the name, address and credit card number of the purchaser. The data provided by you are necessary for the fulfillment of the contract or for the implementation of pre-contractual measures. Without this data we cannot conclude the contract with you.

A transmission of the data takes place to e.g. the processing banking institutions/payment service providers for the purpose of debiting the purchase price, to the transport company/shipping company commissioned by us or the delivery of the goods as well as to our tax advisor and for the purpose of fulfilling our obligations under tax law. These have undertaken to comply with the applicable data protection regulations vis-à-vis us. An order processing contract has been concluded in accordance with Art 28 DSGVO.

The data processing is carried out on the basis of the legal provisions of § 96 para 3 TKG and Art 6 DSGVO. Legal storage obligations (e.g. according to accounting regulations) remain unaffected.

Cookies, other tracking tools and web analysis

Cookies are small pieces of text information that make it possible to recognize the user and analyze your use of our websites. The information thus generated is transferred to the provider's server and stored there. They are used to make our website more user-friendly, more effective and more secure. In addition, cookies are used to measure the frequency of page views and for general navigation.

Cookies, other tracking technologies as well as web analysis service functions can be used on our internet platform in a variety of ways.

ur IP address is recorded, but pseudonymized immediately [e.g. by deleting the last 8 bits]. This means that only a rough localization is possible.

Data processing is based on the legal provisions of § 96 Abs 3 TKG and Art 6 DSGVO (in particular consent). Since the privacy of our users is important to us, the user data is pseudonymized .

Plugins from Instagram

On this website, functions and plugins of the social network Instagram are integrated. These functions are offered by Instagram Inc, 1601 Willow Road, Menlo Park, CA 94025, USA.

If you are logged into your Instagram account, you can link the content of this website to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate your visit to this page with your user account. We would like to point out that we, as the provider of the website, have no knowledge of the content of the transmitted data or its use by Instagram.

Consent and right of revocation

If your consent is required for the processing of your data, we will only process it after your express consent.

In principle, we do not process data of minors and are not authorized to do so. By giving your consent, you confirm that you have reached the age of 14 or that you have the consent of your legal representative.

In such a case, the data previously stored about you will be anonymized and subsequently used only for statistical purposes without personal reference. By means of the revocation of consent, the lawfulness of the processing carried out on the basis of the consent until the revocation is not affected.

After exercising your right to object, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the assertion, exercise or defense of legal claims.

Data security

mariedares e.U uses technical and organizational security measures in order to protect the stored personal data against accidental or intentional manipulation, loss or destruction and against access by unauthorized persons. Our security measures are continuously improved according to technical progress.

Your rights

You have the right to obtain information from the data controller about the personal data concerned at any time. Insofar as there is no legal obligation to retain data, you have the right to have this data deleted and to object to its processing. Furthermore, you have the right to correct the data as well as to restrict processing, to data portability as well as to lodge a complaint with the Austrian Data Protection Authority (Wickenburggasse 8-10, 1080 Vienna, e-mail: dsb@dsb.gv.at).
